Midnight Cat Studios Messaging Terms (RCS & SMS)

These Messaging Terms govern the Midnight Cat Studios messaging program (the "Program"), operated by Midnight Cat Studios LLC ("Midnight Cat Studios," "we," "us"). The Program is separate from, and in addition to, our Terms of Service and Privacy Policy. Where these Messaging Terms conflict with our general Terms of Service on a messaging matter, these Messaging Terms control.
By opting in, you agree to these Messaging Terms.
1. What the Program Is
The Program delivers messages over RCS (Rich Communication Services) where your device and carrier support it, and falls back to SMS or MMS where they do not. You may receive either format at any time, and the fallback happens automatically without further notice to you.
Messages may include:
- Order confirmations, shipping updates, and delivery notifications
- Cart and browse reminders
- Product launches, restocks, and promotional offers
- Customer support replies
- Rich RCS content such as branded cards, image carousels, suggested-reply chips, and tappable action buttons
2. How RCS Differs From SMS
If you receive our messages over RCS, the following apply and do not apply to standard SMS:
- Verified sender. Our RCS agent is verified through the RCS Business Messaging program. Your device may display our brand name, logo, and a verification badge. A verified badge confirms sender identity only. It is not an endorsement of any offer, price, or claim in the message.
- Data, not message credits. RCS messages travel over your mobile data or Wi-Fi connection and generally do not count against an SMS or MMS allotment. Mobile data charges from your carrier may apply.
- Delivery and read receipts. RCS may report to us when a message is delivered to your device and when it is opened. Typing indicators may be visible during live support conversations.
- Interaction data. Taps on suggested replies, buttons, and cards are transmitted to us and recorded as described in Section 6.
- Encryption. Business messaging over RCS is not end-to-end encrypted. Do not send payment card numbers, government identification numbers, passwords, or health information through this channel.
- Rich content. RCS messages may include images, video, and interactive elements that consume more data than a text message.
3. Opt-In and Consent
You are enrolled in the Program only after affirmative opt-in, through one of:
- Submitting your mobile number in a sign-up form, checkout field, or pop-up on our store with the consent language displayed
- Texting a keyword to our published number
- Providing your number to a Midnight Cat Studios representative and confirming enrollment
Consent is not a condition of any purchase. You confirm that you are the account holder or the customary user of the number provided, and that you are authorized to consent to messages at that number. You agree to notify us if the number is reassigned or is no longer yours.
You must be at least 18 years old to enroll.
4. Message Frequency, Rates, and Carriers
Message frequency varies.
Message and data rates may apply, per your plan with your wireless provider. Midnight Cat Studios does not charge you for messages in the Program.
Carriers, RCS platform operators, and messaging providers are not liable for delayed, undelivered, or misdirected messages. Delivery depends on your device, operating system, carrier, RCS availability in your region, and network conditions, none of which we control.
5. Opting Out and Getting Help
To stop: reply STOP to any message, or tap the unsubscribe or "Stop promotions" suggested reply in an RCS conversation. You will receive one confirmation message, after which we will stop sending Program messages to that number. You may continue to receive transactional messages tied to an open order unless you request otherwise.

Opting out through one channel does not opt you out of email or other channels. Turning off RCS on your device may cause our messages to arrive as SMS or MMS rather than stopping them. Use STOP to leave the Program.
To rejoin, opt in again through any method in Section 3.
6. Information Collected Through the Program
In connection with the Program we collect and process:
- Your mobile number and the opt-in record, including date, time, and method of consent
- Message content you send to us, including support conversations
- Delivery, read, and interaction signals described in Section 2
- Device and carrier attributes needed to route messages, including whether your device supports RCS
We use this information to send and route messages, provide support, measure campaign performance, segment audiences, and meet recordkeeping obligations. Our full practices, including any use for advertising and profile building, are described in our Privacy Policy.
We do not sell your mobile number or messaging consent to third parties. Mobile information is shared only with the vendors that operate the Program on our behalf, and those vendors are contractually barred from using it for their own marketing.
7. Acceptable Use
Do not use the Program to transmit unlawful, abusive, harassing, or infringing content, to impersonate another person, or to attempt to disrupt or reverse engineer the messaging service. We may suspend or terminate your participation for any of the above, or for any reason, at our discretion.
8. Limitation of Liability
To the fullest extent permitted by law, Midnight Cat Studios is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the Program, including failed or delayed delivery, charges imposed by your carrier, or third-party access to messages on a device you do not secure. The Program is provided on an "as is" and "as available" basis.
9. Changes to These Terms
We may update these Messaging Terms at any time. The revised version takes effect when posted at this URL, and continued participation after posting constitutes acceptance. If a change materially expands how we use your number, we will provide notice through the Program before it takes effect.
